Data Use Agreement
You sign this agreement on behalf of your company before starting the survey and uploading operational data. The agreement sets out how Dmunoz Group will use, protect and retain those data for the diagnosis and for studies using aggregated, anonymized information.
Parties and representation
This agreement binds Dmunoz Group, a process and technology consultancy located in Lima, Peru, and the company you represent. You declare that you have authority to share your company’s data and accept this agreement on its behalf.
Purpose of use
Dmunoz Group will analyze the data your company uploads to help it make decisions, prepare a diagnostic report and develop proposals addressed to it. This includes Excel files covering accounts receivable, inventory, sales, purchasing, production and job positions. For studies, academic research, including theses, and publications, it will use only aggregated and fully anonymized data that cannot identify companies or individuals.
Prohibition on sale and transfer
Dmunoz Group does not sell, transfer or rent your company’s data or information. It does not publish detailed data through any medium.
Aggregated and anonymized publication
Dmunoz Group will publish only aggregated and irreversibly anonymized information. It will exclude the names of companies, customers, suppliers and individuals, as well as Peruvian taxpayer identification numbers (RUC), identity document numbers and any other identifiers that could reveal their identities. Each published figure will combine data from at least five companies. Meeting that minimum will not justify publication if the information could still identify a company or individual.
Data access
Only Dmunoz Group, through its analysis team or data laboratory, and your company will have access to detailed data. Your company will view only its own data through a private link. Software tools that assist in drafting interpretations will receive only aggregated figures without identifiers.
Security measures
Dmunoz Group undertakes to protect the data through technical and organizational measures. It will apply role-based access restrictions, encryption in transit, access logging and backups.
Retention and erasure
Dmunoz Group will retain detailed data for 24 months from your company’s most recent upload. At the end of that period, it will irreversibly anonymize the data and delete the original files and identifiers. It will retain anonymized aggregates indefinitely. Your company may request erasure before that period ends.
Personal data rights
Individuals whose personal data are processed may exercise their rights of access, rectification, erasure and objection (ARCO), under Peruvian Law 29733 and its Regulation approved by Supreme Decree 016-2024-JUS, by emailing damunoz@dmunozgroup.com. Dmunoz Group will respond to access requests within a maximum of 20 business days and to rectification, erasure and objection requests within a maximum of 10 business days, counted from the day following submission. Data subjects may lodge a complaint with Peru’s National Authority for Personal Data Protection. Legal reference: https://www3.congreso.gob.pe/Docs/DGP/DIDP/files/ds_016-2024-jus.pdf.
Electronic signature and record
Your acceptance constitutes an electronic signature under Peruvian Law 27269; it is not a certificate-based digital signature. Signing records your name, position, company, identity document number, date and time, IP address, browser and the version of the accepted text, together with a SHA-256 hash calculated from that text and the signatory’s data. You receive a PDF of the signed agreement. Legal reference: https://www.gob.pe/institucion/congreso-de-la-republica/normas-legales/292289-27269.
